General Terms and Conditions of the International WaterCentre Alumni Network
Any business relations of the International WaterCentre Alumni Network (in the following referred to as ‘IWCAN’) are exclusively regulated by the following terms and conditions. Changes of those terms and conditions have to be agreed in writing. We do not accept differing terms and conditions of a customer in whole or in part, unless we have explicitly agreed to those in writing.
Publications, documents, data bases, internet services, newsletters, articles, photographs, pictures, printed matter and any other products of IWCAN are protected by copyright law. All rights reserved. Copying, distribution, rental, electronic transmission and any other use in whole or in part are prohibited unless formally granted in writing by IWCAN.
Personal information, texts, graphics, photography and all other information (in the following referred to as ‘data’) have been provided by courtesy of our members and third parties (in the following referred to as ‘members’) and are protected by copyright law. Members are liable for the data that they transfer to IWCAN and have to ensure that the data is truthful and that they as members have full ownership of copyright and right of use of those data and don’t violate existing law. Hence, IWCAN does not assume auditing duty and is indemnified from all claims of any third party that could follow from a violation of these duties. There is no entitlement of the admission to, or disposition of data on the online database and services of IWCAN. IWCAN does not accept any liability for the transmission accuracy or completeness of the provided data, with the proviso that all parts of the online databases, internet services and further publications of IWCAN including all of their content can be changed, expanded, deleted or the service provision temporarily halted without further notice.
Login credentials that we have sent to our members (i.e. user name and passwords) authorise our member to use our offers and services regulated by our terms and conditions. The login credentials are strictly confidential and must not be made accessible to a third party. This includes but is not limited to the disclosure of login credentials to third parties, as well as recording documentation of login credentials that is accessible for third parties. If the login credentials have been disclosed unintentionally or have been used improperly, the member has to inform IWCAN immediately.
The prices at the time of purchase apply. Unless agreed differently in writing prices are quoted inclusive of GST% in Australian Dollars.
Data that has been transferred by the member to IWCAN is being stored or transferred in accordance with the applicable data protection policy. IWCAN is granted permission to publish organisations’ names, websites and places of location on IWCAN website, of which registered clients are employed. IWCAN is granted permission to process data that has been transferred by a member to IWCAN for the by the member intended purposes. Members grant IWCAN the right to make certain personal data of their "personal profiles" accessible to other registered members. This declaration of consent can be withdrawn any time by sending and email to email@example.com.
Publications on the IWCAN website and all other information are intended for general education, but not for individual consultation. All information is given to the best of our knowledge, but no responsibility is taken for the correctness of this information. Even though we strive to present accurate and truthful information we take no responsibility for accurate, complete, unambiguous, contextually correct, undistorted or unbiased information and statements. Liability is excluded unless verifiable deliberate intention or gross negligence can be asserted. This includes but is not limited to legal claims due to damages of material or non-material kind, that have been caused by the use or non-use of the provided information or the use of flawed or incomplete information but does not exempt from a careful review regarding appropriateness for the intended processes and uses. The use of IWCAN’s data, products and services is at the member’s own risk, including but not limited to functionality and virus-free databases, programmes, internet services, newsletter, emails, documents and any other internet-transferred data. We would like to point out that the transmission of any data on the Internet carries general risks. Any user of data, products and services of IWCAN ought to conduct regular backups, at least daily.
Terms of payment and reservation of proprietary rights
The purchasing price is payable immediately and in full. Members may pay via bank transfer. In case of a delay in payment, IWCAN will charge interest for delay at 5% above the official base rate. We reserve the right to claim for additional damage caused by the delay. Forasmuch as a member pays by automatic debit transfer system/direct debit we demand payment with the release of our products and services. Online profiles shall remain inactive until payment has been received in full.
Trademarks, brand labels and/or patent protection
All use of descriptions, brand names and images are liable to the owner’s trademark, brand label and/or patent protection. A representation of such descriptions or images by IWCAN, even without special designation, does not entitle their free use by third parties.
Links to other Internet sites
Despite careful examination of links referring to external sites, we do not assume liability for such links. The operator is solely responsible for the content of such sites. This applies to all links on the IWCAN website that refer to external websites and their content, that have referred to external websites in the past or will refer to external websites in the future.
Should any provision of this Contract be or become invalid, ineffective or unenforceable as a whole or in part, the validity, effectiveness and enforceability of the remaining provisions shall not be affected thereby. Any such invalid, ineffective or unenforceable provision shall be deemed replaced by such valid, effective and enforceable provision as comes closest to the economic intent and the purpose of such invalid, ineffective or unenforceable provision as regards subject-matter, amount, time, place and extent.
Place of fulfilment, general regulations
Each party waives all defences of lack of personal jurisdiction and forum non-convenience and agrees that process may be served on either party in a manner authorized by applicable law or court rule. If for any reason a court of competent jurisdiction finds any provision of the Agreement to be unenforceable, that provision will be enforced to the maximum extent possible to effectuate the intent of the parties and the remainder of the Agreement shall continue in full force and effect. This Agreement will be governed by and interpreted in accordance with the laws of the Australian Government. This Agreement shall not be governed by any other national law or international sales law.
We are concerned about the protection of your privacy and of your personal information. In the following we inform you how we ensure this protection and which data we collect and for which purpose.
Anonymous data collection
You can access the IWCAN website without telling us who you are. Each access to our website and each access of data that is provided on our website is recorded on our server log files for internal technical and statistical use. We record the following: The name of your Internet Service Provider, the website from which you access the IWCAN website, which of our pages you click on, the name of the accessed files, date and time of the access, transferred data volume, a message about successful transfers, type of web browser and the domain, as well as the internet protocol address of the computer that is accessing our website. In this process you remain anonymous as an individual user. We only record personal information when certain services are being used.
Use and sharing of personal information
We only collect personal information to the extent that you knowingly share this information with us. Such personal information may be used without your specific agreement for contractual purposes and for processing your inquiries only. The use for advertising/marketing purposes and for tailoring IWCAN’s electronic services to members’ needs only occurs if you specifically give us permission to do so. The use of such data for personalised advertising only occurs if you have granted permission to such use. We do not share your information with third parties. We may only share your information with a third party, if we are legally obliged to do so. Your respective permission for the use of such information can be withdrawn at any time with immediate but not retroactive effect.
Export and processing of data
Only anonymous data that is being collected when visiting our website may be analysed by Google Inc. (USA) through the web analysis tool “Goolge Analytics”.
If you wish to receive the IWCAN newsletter, we need a valid email address from you, in addition to further information that help us to confirm rightful ownership of the provided email address, or the agreement of the owner of the provided email address to receiving the newsletter. Further data will not be collected. You may withdraw your agreement to the storage of your data, email address as well as their use for the distribution of the IWCAN newsletter any time.
To provide you with best possible access to information, we may include links on our website and in our newsletter that refer to websites of third parties. We would like to inform you that these are external links. IWCAN has no influence over the content or the design of such third parties’ websites. The terms and conditions of this data protection policy do not apply to such websites.
